PRÉAMBULE ET GARANTIES
La vente sera faite au comptant et conduite en euros.
Conformément à la loi, les indications portées au catalogue engagent la responsabilité du Commissaire-Priseur, sous réserve des rectifications éventuelles annoncées au moment de la présentation de l’objet et portées au procès-verbal de la vente. Le rapport concernant l’état du lot, relatif à un accident ou à une restauration, est fait pour faciliter l’inspection et reste soumis à l’appréciation d’un examen personnel de l’acheteur ou de son représentant. L’absence d’une telle référence dans le catalogue n’implique aucunement qu’un objet soit exempt de tout défaut ou de toute restauration. L’exposition préalable permet de voir l’état des biens ; de ce fait, aucune réclamation ne sera possible par rapport aux restaurations d’usage et petits accidents. Les Lots seront mis en vente tels quels, avec leurs imperfections, leurs défauts et leurs erreurs éventuelles de description. Militaria Auctions ne peut en aucun cas être tenue responsable des descriptions et estimations contenues dans les catalogues, celles-ci étant purement indicatives, en ce compris la table des états proposée par Militaria Auctions. Il en va de même en ce qui concerne les précisions concernant la signature, la date, la provenance, l’origine et l’état des Lots. Les Acheteurs, professionnels ou non, ont le loisir de visualiser et d’expertiser tout Lot et/ou de demander toute information à son sujet avant la vente et lors de l’exposition de celui-ci. Militaria Auctions se réserve le droit exclusif de photographier le Lot et d’insérer ou non une photo dans le catalogue ou sur le Site Internet. Les photos présentées dans les catalogues ou sur le Site Internet ne sont pas contractuelles et sont purement informatives. L’Enchérisseur (y compris l’Acheteur) se fera sa propre opinion sur le Lot et il ne sera admis aucune réclamation, de quelque nature qu’elle soit, même si elle a pour objet la description, l’estimation, le contenu, ou l’état des Lots dans le catalogue ou sur le Site Internet une fois l’adjudication prononcée. En tout état de cause, Militaria Auctions ne pourra être tenue responsable des dommages qu’à concurrence de la somme des commissions effectivement perçues par Militaria Auctions à charge du Vendeur et de l’Acheteur.
ENCHÈRES :
Les enchères suivent l’ordre des numéros du catalogue. Militaria Auctions est libre de fixer l’ordre de progression des enchères et les enchérisseurs sont tenus de s’y conformer. Le plus offrant et dernier enchérisseur sera l’adjudicataire. En cas de double enchère reconnue effective par Militaria Auctions, l’objet sera remis en vente, tous les amateurs présents pouvant concourir à cette deuxième mise en adjudication. Dès l’adjudication les objets sont placés sous l’entière responsabilité de l’acheteur. Il lui appartient d’assurer les lots dès l’adjudication. Militaria Auctions se réserve toutefois la possibilité de refuser discrétionnairement une enchère ou d’exclure un Enchérisseur, et ce avant ou pendant une vente. L’Enchérisseur peut donner des ordres d’achat et participer aux enchères par téléphone (pour les Ventes Cataloguées). Dans ce dernier cas, l’Enchérisseur devra confirmer sa participation à la vente par lettre ou par e-mail, communiquer son identité, et tous renseignements qui seraient demandés par Militaria Auctions. Celle-ci se réserve notamment le droit de demander des références bancaires. Militaria Auctions ne pourra être tenue responsable de toutes erreurs de l’Enchérisseur, en ce compris dans l’indication du numéro de Lot, du numéro de téléphone, ou de tous problèmes de communications et/ou de réception des courriers ou e-mails (téléphones occupés, lignes interrompues, portables, etc.). L’Enchérisseur est conscient et assume les risques inhérents à ce procédé. Si deux ordres d’achat portent sur le même Lot pour le même montant, la préférence sera donnée à l’ordre arrivé en premier.
RETRAIT DES ACHATS
Dès l’adjudication, l’objet sera sous l’entière responsabilité de l’adjudicataire. L’acquéreur sera lui-même chargé de faire assurer ses acquisitions, et Militaria Auctions décline toute responsabilité quant aux dommages que l’objet pourrait encourir, et ceci dès l’acquisition prononcée. Toutes les formalités, notamment celles concernant l’exportation, ainsi que les transports restent à la charge exclusive de l’acquéreur. L’objet, en fonction de son volume, pourra être remis dans nos locaux. Les frais de stockage seront pris en charge par Militaria Auctions pendant une durée d’un mois à partir de la date de la vente. Au-delà de ce délai, le tarif sera de 25 € TTC par mois jusqu’à 5 m³. L’enlèvement du lot acquis se fait sur rendez-vous et sur présentation du bordereau acquitté. Le paiement reste dû pendant les périodes de fermeture.
Ventes Cataloguées :
Les Ventes Cataloguées se tiennent physiquement à une date donnée et sont précédées d’une exposition des Lots mis en vente (à l’exception des Lots mis en vente sur désignation, qui peuvent néanmoins être examinés à l’endroit où ils se trouvent). Elles se tiennent sous l’égide d’un huissier de justice et d’un commissaire-priseur. En cas de contestation, seul l’huissier de justice ou le commissaire-priseur présent peut décider de recrier le Lot. Leur décision est irrévocable et s’impose à tous, sans contestation possible.
Ventes Online
Les Ventes Online se déroulent exclusivement sur une plateforme internet. Elles sont systématiquement précédées d’une exposition au cours de laquelle tous les Lots peuvent être examinés « physiquement » par toute personne intéressée. Les enchères sont gérées automatiquement par le système informatique selon les principes généraux des enchères. En cas de contestations sur les enchères, les données enregistrées par le système informatique feront foi et Militaria Auctions déterminera l’Enchérisseur gagnant sur cette seule base. Cette décision est irrévocable et s’impose à tous, sans contestation possible. Militaria Auctions peut annuler, reporter, prolonger ou mettre fin à une Vente Online sans justification aux Vendeurs et aux Enchérisseurs, potentiels ou existants. Militaria Auctions peut rouvrir la vente aux enchères après une interruption, notamment si un problème était survenu sur le Site Internet ayant empêché les utilisateurs d’y accéder de manière optimale, et ce au moment et de la manière qui lui semblent les plus adéquats. Militaria Auctions est seule décisionnaire du report d’une vente aux enchères dans le cas où le live de celle-ci serait interrompu.
Vendeur
Le Vendeur déclare être majeur et capable juridiquement.
Propriété du bien/Lot mis en vente : Le Vendeur déclare et garantit à Militaria Auctions qu’il est l’unique propriétaire exclusif du ou des biens/Lots qu’il propose en vente et que celui-ci ou ceux-ci sont libres de tout droit et/ou charge ou entraves généralement quelconques. Militaria Auctions se réserve le droit, sans avertissement préalable et sans obligation de motivation, de refuser et/ou d’exclure de la vente un bien dont la qualité, la provenance et/ou l’authenticité suscite un quelconque doute. Le Vendeur a l’obligation de vérifier que la description, l’estimation, le contenu, ou l’état des Lots dans le catalogue ou sur le Site Internet est conforme à la réalité et a la possibilité de signaler en temps utile à Militaria Auctions une erreur et/ou de proposer une adaptation. A défaut d’émettre en temps utile une réserve expresse, à laquelle Militaria Auctions n’aurait pas donné suite, le Vendeur garantit Militaria Auctions contre toute éventuelle réclamation à son encontre provenant d’un Enchérisseur (y compris l’Acheteur) ou de tout tiers.
Prix de réserve : Le Vendeur a le droit de proposer un prix de réserve pour les ventes, c’est-à-dire un prix minimum en dessous duquel un bien/Lot ne sera pas adjugé. Moyennant accord de Militaria Auctions, ce prix de réserve figurera sur le bordereau de dépôt. Le prix de réserve ne pourra pas être modifié, sauf l’accord du Vendeur et de Militaria Auctions. En aucun cas, il ne sera fixé de prix de réserve pour un Lot/bien estimé en dessous de 200 €. Si le bien/Lot n’atteint pas la réserve convenue, il sera retiré de la vente. Dans ce cas, le Vendeur ne pourra prétendre à aucun paiement et devra venir chercher le bien/Lot sur rendez-vous chez Militaria Auctions dans les 15 jours qui suivent la date de vente. Tout bien/Lot invendu non enlevé dans le délai fixé sera entreposé aux frais (2 € par jour/par bien/Lot) et aux risques du Vendeur. Militaria Auctions ne pourra être tenue responsable d’aucune perte et/ou dommage encourus, pour quelque cause que ce soit. Durant le délai s’écoulant entre la vente et le retrait du bien/Lot invendu, Militaria Auctions s’engage uniquement à conserver le bien/Lot en bon père de famille. Le transport des Lots est à charge du Vendeur et Militaria Auctions n’est pas responsable des dégâts ou dommages qui se produiraient lors du stockage, de l’emballage, de la manutention ou du transport du bien/Lot invendu. Par ailleurs, sans préjudice de ce qui précède, Militaria Auctions aura la faculté de remettre en vente le bien/Lot, sans avis préalable, moyennant une diminution du prix de réserve de 30% aux risques et périls du Vendeur, lequel renonce expressément à revendiquer tout dommage ou indemnisation quelconque. Le Vendeur s’engage formellement à ne pas enchérir ou de faire enchérir de manière directe ou indirecte sur un bien/Lot qu’il met en vente. Militaria Auctions s’engage à payer au Vendeur une somme équivalente au prix d’adjudication du Lot diminuée de 20% de frais pour les ventes dans un délai de 30 jours à dater du paiement complet de l’Acheteur. En cas de défaillance de l’Acheteur, Militaria Auctions pourra décider de poursuivre ou non l’exécution forcée de la vente. A défaut de poursuite, la vente sera considérée comme nulle et non avenue et le Lot sera restitué au Vendeur sans autre contrepartie ou dédommagement. Dans ce cas, et si le Vendeur le demande, Militaria Auctions s’engage à remettre en vente le Lot aux conditions convenues entre eux. Sauf convention contraire entre les parties, le transport des biens mis en vente sera assuré et pris en charge par Militaria Auctions. Sauf accord préalable et écrit de Militaria Auctions ou décision judiciaire, le Lot mis en vente et repris dans un bordereau de dépôt ne pourra en aucun cas être repris avant la vente. Le bien/Lot mis en vente est assuré par Militaria Auctions à partir de sa réception en main par Militaria Auctions. En signant le bordereau de dépôt contenant les Conditions Générales, le Vendeur reconnaît expressément avoir pris connaissance de celles-ci et de les accepter, sans réserves ni remarques aucunes. Il reconnaît avoir reçu un exemplaire du bordereau de dépôt.
Enchérisseur
Pour enchérir, l’Utilisateur doit d’abord avoir un compte Utilisateur valide. Militaria Auctions dispose d’une totale liberté discrétionnaire pour valider ou non un compte Utilisateur et pour supprimer un compte Utilisateur existant. L’Enchérisseur peut enchérir de plusieurs manières : enchères, ordres d’achat et enchères téléphoniques pour ce dernier uniquement pour les Ventes Cataloguées. Militaria Auctions peut décider d’une manière discrétionnaire de ne pas accepter une enchère ou d’exclure un Enchérisseur, et ce avant ou pendant la vente. L’Enchérisseur est censé accepter les Conditions Générales par le seul fait de son inscription et sa participation à la vente.
Acheteur
L’Acheteur est l’Enchérisseur à qui le Lot est adjugé. Tout Acheteur est réputé, vis-à-vis de Militaria Auctions, agir en son nom personnel, même pour les Lots qu’il aurait acquis en qualité de mandataire ou autrement. L’Acheteur communiquera à Militaria Auctions son nom, son adresse, son numéro de téléphone, son adresse e-mail et sa carte d’identité ou son passeport, de même que tout renseignement, notamment d’ordre bancaire, qui serait demandé par Militaria Auctions. L’Acheteur est censé accepter les Conditions Générales par le seul fait de son inscription et/ou sa participation à la vente.
Prix de vente et droit de suite
La vente est conclue directement entre le Vendeur et l’Acheteur selon le prix d’adjudication, majoré :
– Pour les Ventes Cataloguées, de 26,2 % TTC (voir conditions de la vente) de frais
– Pour les lots remportés via la plateforme LiveAuctioneers, l’acheteur devra s’acquitter d’une majoration du prix de 5 % TTC
– Pour les lots remportés via la plateforme Lot-tissimo, l’acheteur devra s’acquitter d’une majoration du prix de 5 % TTC
– Pour les lots remportés via la plateforme Interenchères, l’acheteur devra s’acquitter d’une majoration du prix de 1,8 % TTC
Conformément aux dispositions légales frappant d’un droit de suite les actes de reventes d’œuvres d’art originales dans le cas d’enchères publiques au bénéfice des auteurs des œuvres vendues, il sera dû par l’Acheteur en sus du prix de vente, hors taxes, un droit de suite et pour autant que l’adjudication soit égale ou supérieure à 2.000 €. Le droit de suite est dégressif ; il est notamment de 4% pour la tranche du prix de vente jusqu’à 50.000 €. Le montant du droit est fixé par le législateur et rappelé par l’huissier de justice à chaque Vente Cataloguée. Pour les Ventes Online, les Enchérisseurs se renseigneront préalablement et prendront tous les conseils et informations en la matière (par exemple sur le site internet suivant : https://www.resaleright.be/). S’il apparaît qu’un droit de suite n’a pas été comptabilisé alors qu’il est dû à l’auteur, l’Acheteur règle ce droit de suite à première demande par l’intermédiaire de Militaria Auctions et décharge Militaria Auctions de toute responsabilité et réclamation à cet égard.
Paiement, facturation et TVA
Dès l’adjudication du Lot à un Acheteur, les risques lui sont transférés et il est tenu de payer le prix d’adjudication, majoré des frais, droit de dossier et droit de suite tels qu’indiqués ci-dessus. Militaria Auctions accepte les paiements en espèces dans le respect de la réglementation en vigueur, les virements, les chèques certifiés par une banque belge, ainsi que certains paiements électroniques. Le règlement des achats par voie électronique n’entraîne d’aucune sorte la responsabilité de Militaria Auctions. Militaria Auctions n’est pas responsable d’un quelconque dommage, direct ou indirect, encouru par un paiement sur Internet. L’Acheteur reste donc responsable du bon déroulement du paiement des Lots acquis lors des ventes aux enchères de Militaria Auctions et ne pourra se retrancher derrière une erreur, un problème ou une quelconque fraude « informatique ». Toute demande de facturation doit être faite au plus tard dans les huit jours ouvrables suivant la date d’adjudication. Militaria Auctions travaillant sous le régime particulier d’imposition de la marge bénéficiaire applicable aux biens d’occasion, aux objets d’art, de collection ou d’antiquité, la TVA, incluse dans le prix de vente des biens, n’est pas déductible par l’Acheteur.
Fichier des restrictions d’accès aux ventes aux enchères
NOTICE D’INFORMATION
(1) Finalité et base légale du Fichier TEMIS
Militaria Auctions est abonnée au Service TEMIS permettant la consultation et l’alimentation du Fichier des restrictions d’accès aux ventes aux enchères (« Fichier TEMIS ») mis en oeuvre par la société Commissaires-Priseurs Multimédia (CPM), société anonyme à directoire, ayant son siège social sis à (75001) Paris, 14 rue des Pyramides, immatriculée au registre du commerce et des sociétés de Paris sous le numéro 437 868 425.
Tout bordereau d’adjudication demeuré impayé auprès de Militaria Auctions ou ayant fait l’objet d’un retard de paiement est susceptible d’inscription au fichier TEMIS.
Le Fichier TEMIS recense les incidents de paiement des bordereaux d’adjudication (retards et défauts de paiement), quel que soit le mode de participation des enchérisseurs (présentiel ou à distance) et peut être consulté par toutes les structures de ventes aux enchères abonnées au service.
L’enchérisseur est informé qu’à défaut de régularisation de son bordereau d’adjudication dans le délai mentionné sur le bordereau, une procédure d’inscription audit fichier pourra être engagée par Militaria Auctions.
La mise en oeuvre du Fichier TEMIS et son utilisation par Militaria Auctions est nécessaire aux fins de l’intérêt légitime des abonnés au Service TEMIS de prévenir les impayés et sécuriser ainsi les ventes aux enchères.
(2) Organismes autorisés à consulter le Fichier TEMIS (destinataires)
Le Fichier TEMIS peut être consulté par toute structure de vente abonnée (professionnels et sociétés habilités à diriger des ventes de meubles aux enchères publiques conformément à la réglementation applicable et notamment aux prescriptions du Titre II » Des ventes aux enchères » du Livre III du Code de commerce (ci-après les « Professionnels Abonnés »)), souhaitant se prémunir contre les impayés et sécuriser ainsi la participation aux ventes aux enchères qu’ils organisent. Conséquence d’une inscription au Fichier TEMIS
Dans le cas où un enchérisseur est inscrit au fichier TEMIS, Militaria Auctions pourra conditionner l’accès aux ventes aux enchères qu’elle organise à l’utilisation de moyens de paiement ou garanties spécifiques ou refuser temporairement la participation des enchérisseurs aux ventes aux enchères pour lesquels ces garanties ne peuvent être mises en oeuvre.
L’inscription au fichier TEMIS pourra avoir pour conséquence de limiter la capacité d’enchérir de l’enchérisseur auprès des professionnels abonnés au service TEMIS.
(3) Durée d’inscription
Elle entraîne par ailleurs la suspension temporaire de l’accès au service « live » des plateformes www.interencheres.com gérées par CPM, conformément aux conditions générales d’utilisation de ces plateformes.
Les enchérisseurs sont informés du fait que la durée de l’inscription sur le Fichier TEMIS est déterminée par le nombre de bordereaux d’adjudications restés impayés auprès des Professionnels Abonnés au Fichier TEMIS, par leurs montants cumulés et par leur régularisation ou non. La durée de l’inscription au Fichier TEMIS est réduite si l’Enchérisseur régularise l’ensemble des Incidents de paiement. Elle est augmentée lorsque l’enchérisseur est concerné par plusieurs bordereaux impayés inscrits au Fichier TEMIS.
L’inscription d’un bordereau d’adjudication en incident de paiement est supprimée automatiquement au maximum à l’issue d’une durée de 24 mois lorsque l’enchérisseur ne fait l’objet que d’une seule inscription, et de 36 mois lorsque l’enchérisseur fait l’objet de plusieurs inscriptions.
(4) Responsabilités
Pour l’application de la législation en matière de protection des données personnelles, CPM et Militaria Auctions ont tous deux la qualité de responsable de traitement.
CPM est responsable de la mise en oeuvre du Fichier TEMIS, ce qui inclut notamment la collecte de données auprès des abonnés, la mutualisation et la diffusion des données à caractère personnel qui y sont recensées, ainsi que la sécurité du système d’information hébergeant le Fichier TEMIS.
Militaria Auctions, en tant qu’abonné est responsable de son utilisation du Fichier TEMIS, ce qui inclut notamment la communication des données à caractère personnel relatives aux adjudicataires à CPM en vue de l’inscription au Fichier TEMIS, la vérification de l’exactitude et la mise à jour des données, la consultation, ainsi que la réutilisation des informations du Fichier TEMIS.
(5) Droits des personnes
Les enchérisseurs souhaitant savoir s’ils font l’objet d’une inscription au Fichier ou contester leur inscription peuvent adresser leurs demandes par écrit en justifiant de leur identité par la production d’une copie d’une pièce d’identité :
– Pour les inscriptions réalisées par Militaria Auctions : par écrit auprès de Militaria Auctions, Chaussée de Wavre 504/5A, 1390 Grez-Doiceau, Belgique,
Pour les inscriptions réalisées par d’autres Professionnels Abonnés : par écrit auprès de Commissaires-Priseurs Multimédia 14 rue des Pyramides, 75001 Paris, ou par e-mail contact@temis.auction.
Toute demande tendant à l’exercice des droits d’effacement, de limitation, d’opposition dont dispose l’Enchérisseur en application de la législation en matière de protection des données personnelles, ainsi que toute autre contestation d’une inscription doit être adressée au Professionnel à l’origine de l’inscription qui effectuera une demande de mise à jour auprès de CPM. En cas de difficultés, l’enchérisseur a la faculté de saisir CPM en apportant toute précision et tout document justificatif afin que CPM puisse instruire sa réclamation.
(6) Coordonnées de l’Enchérisseur
L’enchérisseur dispose également du droit de saisir la Commission nationale de l’informatique et des libertés (CNIL) [3 Place de Fontenoy – TSA 80715 – 75334 PARIS CEDEX 07, www.cnil.fr] d’une réclamation concernant son inscription au Fichier TEMIS.
Pour en savoir plus concernant le Fichier TEMIS, l’enchérisseur est invité à consulter la politique de confidentialité de CPM accessible sur temis.auction.
Les notifications importantes relatives aux suites de l’adjudication seront adressées à l’adresse e-mail et/ou à l’adresse postale déclarée par l’enchérisseur auprès de la structure lors de l’adjudication. L’enchérisseur doit informer Militaria Auctions de tout changement concernant ses coordonnées de contact.
Retraits des Lots
Les Lots devront être enlevés par l’Acheteur, après le paiement complet, soit pendant la vente, soit au plus tard dans les 5 jours ouvrables suivant l’adjudication et sur rendez-vous. A la demande expresse et écrite de l’Acheteur, les Lots achetés pourront faire l’objet d’un envoi par un transporteur agréé aux frais et risques exclusifs de l’Acheteur. Militaria Auctions ne pourra être tenue responsable d’aucune perte et/ou dommage encourus, pour quelque cause que ce soit. Durant le délai s’écoulant entre la vente et le retrait des Lots, Militaria Auctions s’engage uniquement à conserver les Lots en bon père de famille. Le transport des Lots est à charge de l’Acheteur et Militaria Auctions n’est pas responsable des dégâts ou dommages qui se produiraient lors du stockage, de l’emballage, de la manutention ou du transport des Lots achetés. En outre, Militaria Auctions est autorisée à prendre, selon son libre choix, sous réserve de tous autres droits et actions, après mise en demeure recommandée, l’une ou l’autre des mesures suivantes :
• exécution forcée de la vente, tous frais notamment d’entreposage aux frais de l’Acheteur ;
• résolution de la vente aux torts de l’Acheteur, tous frais et dommages et intérêts à charge de l’Acheteur défaillant ;
• remise en vente, aux enchères ou non, tout déficit par rapport à la première vente étant à charge exclusive de l’Acheteur défaillant, de même que tous les frais inhérents à la revente.
Site Internet
Le Site Internet est régi par le droit belge et ne garantit dès lors pas une utilisation appropriée dans d’autres pays. L’Utilisateur est seul responsable du respect des législations et règlements locaux qui lui seraient applicables. Le Site Internet ne peut être utilisé qu’à des fins légales et l’Utilisateur s’engage à respecter toutes les conditions et dispositions des Conditions Générales. Le Site Internet ne peut en aucun cas et sous aucun prétexte être utilisé de manière à causer un préjudice quelconque à Militaria Auctions ou à un tiers. Si le Site Internet contient des liens hypertexte vers d’autres sites internet, la responsabilité de Militaria Auctions ne pourra pas être engagée pour aucun problème, dommage, etc. qui résulterait de la visite du(es) site(s) internet renseignés. A titre non exhaustif, la responsabilité de Militaria Auctions ne pourra jamais être engagée si un lien présent sur le Site Internet est porteur d’un virus ou vient à endommager d’une quelque manière que ce soit le matériel de l’Utilisateur, ou encore par exemple si le(s) site(s) renseigné(s) contien(nen)t, volontairement ou non, des informations inexactes, obsolètes, incomplètes, etc. Militaria Auctions ne garantit pas que le Site Internet ne contienne pas d’erreur et fonctionne sans interruption, ni que son contenu et ses fonctionnalités seront à tout moment accessibles sans interruption ni panne. Militaria Auctions peut, à tout moment et sans avertissement ni notification préalable, modifier, adapter ou supprimer en tout ou en partie le contenu et les fonctionnalités du Site Internet, le mettre provisoirement hors service ou à en limiter l’utilisation, notamment s’il le juge nécessaire, par exemple dans le cadre de travaux d’entretien, de réparation ou de (re)construction. Différentes circonstances particulières peuvent intervenir et entraîner des défaillances au niveau de l’utilisation du Site Internet et de ses fonctionnalités, notamment pour les Ventes Online ou les enchères placées en ligne sur le Site Internet. Ces circonstances ne se limitent pas aux seuls cas de force majeure et recouvrent, à titre non exhaustif, les problèmes techniques rendant impossible ou partiellement impossible l’accès au Site Internet et/ou le bon déroulement des enchères (Online ou Cataloguées), à la suite, par exemple, de perturbations au niveau de connexion Internet ou téléphonique ou provoquées par un virus ou erreurs/défauts. Le traitement des données à caractère personnel relatives au Site Internet et aux services de Militaria Auctions est soumis au Règlement général sur la protection des données.
Militaria Auctions a recours à la plateforme TEMIS opérée par la société Commissaires-Priseurs Multimédia, aux fins de gestion du recouvrement des Bordereaux impayés. Dans ce cadre, en cas de retard de paiement, les données à caractère personnel relatives aux enchérisseurs, ou leurs représentants, (notamment identité et coordonnées des enchérisseurs, informations relatives à la vente, bordereaux) sont susceptibles d’être communiquées à CPM aux fins de gestion du recouvrement amiable de créance. CPM intervient en qualité de sous-traitant au sens du Règlement général sur la protection des données (Règlement UE 2016/679 du 27 avril 2016).
Propriété intellectuelle
Le Site Internet, y compris le système des Ventes Online, est la propriété de Militaria Auctions. Militaria Auctions est le possesseur légal de la base de données et peut seul donner quelque autorisation que ce soit en vue d’extraire les informations contenues dans la DB. Toutes les informations données et tous les services fournis ainsi que les logiciels nécessaires sur le Site Internet sont la propriété de Militaria Auctions. Il est interdit de copier, télécharger ou diffuser aucunes informations présentes sur le Site Internet sans le consentement écrit de Militaria Auctions. Les illustrations présentes sur les catalogues et sur le Site Internet sont soumises au droit d’auteur (photographe ou Militaria Auctions). Aucune utilisation de ces illustrations ne peut se faire sans le consentement exprès et écrit de Militaria Auctions. Les descriptions des Lots sont également soumises au droit d’auteur et ne peuvent être utilisées sans l’accord de Militaria Auctions. Tout litige sera de la compétence exclusive des Tribunaux de l’arrondissement judiciaire de Wavre, siégeant en langue française, selon le droit belge exclusivement. Dans le cas où une ou plusieurs clauses des Conditions Générales étaient, en tout ou en partie, nulles, inopposables ou non valides pour un quelconque motif, cette nullité, inopposabilité ou invalidité ne portera pas préjudice aux autres dispositions des Conditions Générales. Militaria Auctions remplacera alors de bonne foi la partie nulle, inopposable ou non valide par une autre disposition ayant un effet économique et juridique équivalent. Les présentes Conditions Générales sont disponibles en français, en néerlandais ainsi qu’en anglais. En cas de contradiction entre la version française et toute autre version ou traduction, la version française prévaudra.
PREAMBLE AND GUARANTEES
The sale shall be conducted for cash and in euros.
In accordance with the law, the information contained in the catalogue engages the responsibility of the Auctioneer, subject to any corrections announced at the time of the presentation of the item and recorded in the official minutes of the sale. The report concerning the condition of the lot, relating to an accident or a restoration, is made to facilitate inspection and remains subject to the assessment resulting from a personal examination by the buyer or their representative. The absence of such a reference in the catalogue does not in any way imply that an item is free from any defect or any restoration. The prior exhibition makes it possible to see the condition of the goods; therefore, no claim shall be possible in relation to customary restorations and minor defects. The Lots shall be offered for sale as they are, with their imperfections, defects and any possible errors in description. Militaria Auctions may under no circumstances be held liable for the descriptions and estimates contained in the catalogues, these being purely indicative, including the condition table proposed by Militaria Auctions. The same applies with regard to the details concerning the signature, date, provenance, origin and condition of the Lots. Buyers, whether professionals or not, are free to view and examine any Lot and/or request any information concerning it before the sale and during its exhibition. Militaria Auctions reserves the exclusive right to photograph the Lot and to insert or not insert a photograph in the catalogue or on the Website. The photographs presented in the catalogues or on the Website are not contractual and are purely informative. The Bidder (including the Buyer) shall form their own opinion of the Lot and no claim of any kind whatsoever shall be admitted, even if it concerns the description, the estimate, the contents, or the condition of the Lots in the catalogue or on the Website once the hammer has fallen. In any event, Militaria Auctions may only be held liable for damages up to the amount of the commissions actually received by Militaria Auctions from the Seller and the Buyer.
AUCTIONS:
The auctions follow the order of the catalogue numbers. Militaria Auctions is free to set the order in which the auctions progress and bidders are required to comply with it. The highest and last bidder shall be the successful bidder. In the event of a double bid acknowledged as effective by Militaria Auctions, the item shall be put back up for sale, all persons present being able to compete in this second adjudication. From the moment of adjudication, the items are placed under the entire responsibility of the buyer. It is the buyer’s responsibility to insure the lots from the time of adjudication. Militaria Auctions nevertheless reserves the right to refuse a bid or to exclude a Bidder at its sole discretion, whether before or during a sale. The Bidder may place absentee bids and participate in the auctions by telephone (for Catalogued Sales). In the latter case, the Bidder must confirm their participation in the sale by letter or e-mail, communicate their identity, and provide any information that may be requested by Militaria Auctions. Militaria Auctions notably reserves the right to request bank references. Militaria Auctions may not be held liable for any errors made by the Bidder, including with regard to the indication of the Lot number, telephone number, or any communication and/or receipt problems concerning mail or e-mails (busy telephones, interrupted lines, mobile phones, etc.). The Bidder is aware of and accepts the risks inherent in this process. If two absentee bids concern the same Lot for the same amount, priority shall be given to the first one received.
WITHDRAWAL OF PURCHASES
From the moment of adjudication, the item shall be under the entire responsibility of the successful bidder. The purchaser shall personally be responsible for insuring their acquisitions, and Militaria Auctions declines all responsibility for any damage that the item may suffer, this from the moment the acquisition is pronounced. All formalities, in particular those concerning exportation, as well as transport, remain the exclusive responsibility of the purchaser. Depending on its volume, the item may be stored on our premises. Storage costs shall be borne by Militaria Auctions for a period of one month from the date of the sale. Beyond this period, the rate shall be €25 incl. VAT per month up to 5 m³. Collection of the acquired lot takes place by appointment and upon presentation of the paid invoice. Payment remains due during closing periods.
Catalogued Sales:
Catalogued Sales take place physically on a given date and are preceded by an exhibition of the Lots offered for sale (with the exception of Lots offered for sale by designation, which may nevertheless be examined where they are located). They are held under the authority of a bailiff and an auctioneer. In the event of a dispute, only the bailiff or the auctioneer present may decide to reoffer the Lot. Their decision is irrevocable and binding on all, without possibility of dispute.
Online Sales
Online Sales take place exclusively on an internet platform. They are systematically preceded by an exhibition during which all Lots may be examined “physically” by any interested person. Bidding is managed automatically by the computer system according to the general principles of auctions. In the event of disputes regarding the bids, the data recorded by the computer system shall prevail and Militaria Auctions shall determine the successful Bidder on that basis alone. This decision is irrevocable and binding on all, without possibility of dispute. Militaria Auctions may cancel, postpone, extend or end an Online Sale without justification to Sellers and Bidders, whether potential or existing. Militaria Auctions may reopen the auction after an interruption, in particular if a problem has arisen on the Website preventing users from accessing it optimally, at the time and in the manner it deems most appropriate. Militaria Auctions alone shall decide whether to postpone an auction sale in the event that the live stream thereof is interrupted.
Seller
The Seller declares that they are of legal age and legally capable.
Ownership of the property/Lot offered for sale: The Seller declares and guarantees to Militaria Auctions that they are the sole and exclusive owner of the property/Lot or Lots they offer for sale and that such property/Lot or Lots are free from any rights and/or charges or encumbrances whatsoever. Militaria Auctions reserves the right, without prior warning and without any obligation to state reasons, to refuse and/or exclude from sale any property whose quality, provenance and/or authenticity gives rise to any doubt whatsoever. The Seller is under an obligation to verify that the description, estimate, contents, or condition of the Lots in the catalogue or on the Website is in accordance with reality and has the possibility to notify Militaria Auctions in due time of an error and/or propose an amendment. Failing an express reservation made in due time, to which Militaria Auctions has not responded, the Seller guarantees Militaria Auctions against any possible claim brought against it by a Bidder (including the Buyer) or any third party.
Reserve price: The Seller has the right to propose a reserve price for sales, that is to say a minimum price below which a property/Lot will not be adjudicated. Subject to the agreement of Militaria Auctions, this reserve price shall appear on the consignment form. The reserve price may not be modified, except with the agreement of the Seller and Militaria Auctions. Under no circumstances shall a reserve price be set for a Lot/property estimated at less than €200. If the property/Lot does not reach the agreed reserve, it shall be withdrawn from the sale. In such case, the Seller shall not be entitled to any payment and must collect the property/Lot by appointment from Militaria Auctions within 15 days following the date of sale. Any unsold property/Lot not collected within the specified time shall be stored at the Seller’s expense (€2 per day/per property/Lot) and risk. Militaria Auctions may not be held liable for any loss and/or damage incurred, for whatever cause. During the period between the sale and the collection of the unsold property/Lot, Militaria Auctions undertakes only to keep the property/Lot with reasonable care. Transport of the Lots is at the Seller’s expense and Militaria Auctions is not responsible for damage or loss occurring during storage, packaging, handling or transport of the unsold property/Lot. Furthermore, without prejudice to the foregoing, Militaria Auctions shall have the right to reoffer the property/Lot for sale, without prior notice, with a reduction of the reserve price by 30% at the Seller’s risk and peril, the Seller expressly waiving any claim for damages or compensation whatsoever. The Seller formally undertakes not to bid or have bidding made directly or indirectly on a property/Lot that they offer for sale. Militaria Auctions undertakes to pay the Seller an amount equivalent to the hammer price of the Lot less 20% in fees for sales within 30 days from full payment by the Buyer. In the event of default by the Buyer, Militaria Auctions may decide whether or not to pursue enforced performance of the sale. Failing such action, the sale shall be deemed null and void and the Lot shall be returned to the Seller without any other consideration or compensation. In this case, and if the Seller so requests, Militaria Auctions undertakes to reoffer the Lot for sale under the conditions agreed between them. Unless otherwise agreed by the parties, transport of the property offered for sale shall be arranged and borne by Militaria Auctions. Unless previously agreed in writing by Militaria Auctions or by court decision, the Lot offered for sale and listed on a consignment form may under no circumstances be withdrawn before the sale. The property/Lot offered for sale is insured by Militaria Auctions from the moment it is received by Militaria Auctions. By signing the consignment form containing the General Conditions, the Seller expressly acknowledges having read them and accepted them, without reservation or remark whatsoever. They acknowledge having received a copy of the consignment form.
Bidder
In order to bid, the User must first have a valid User account. Militaria Auctions has complete discretionary freedom to validate or not validate a User account and to delete an existing User account. The Bidder may bid in several ways: bids, absentee bids and telephone bids, the latter only for Catalogued Sales. Militaria Auctions may decide in a discretionary manner not to accept a bid or to exclude a Bidder, whether before or during the sale. The Bidder shall be deemed to accept the General Conditions by the mere fact of their registration and participation in the sale.
Buyer
The Buyer is the Bidder to whom the Lot is adjudicated. Any Buyer shall be deemed, vis-à-vis Militaria Auctions, to be acting in their own name, even for Lots they may have acquired as agent or otherwise. The Buyer shall communicate to Militaria Auctions their name, address, telephone number, e-mail address and identity card or passport, as well as any information, notably banking information, that may be requested by Militaria Auctions. The Buyer shall be deemed to accept the General Conditions by the mere fact of their registration and/or participation in the sale.
Sale price and resale right
The sale is concluded directly between the Seller and the Buyer according to the hammer price, increased by:
- For Catalogued Sales, 26.2% incl. VAT in fees (see conditions of sale)
- For lots won via the LiveAuctioneers platform, the buyer shall pay an additional 5% incl. VAT on the hammer price
- For lots won via the Lot-tissimo platform, the buyer shall pay an additional 5% incl. VAT on the hammer price
- For lots won via the Interenchères platform, the buyer shall pay an additional 1.8% incl. VAT on the hammer price
In accordance with the legal provisions imposing a resale right on the resale of original works of art in the context of public auctions for the benefit of the authors of the works sold, the Buyer shall owe, in addition to the sale price exclusive of tax, a resale right provided that the adjudication is equal to or greater than €2,000. The resale right is degressive; it is notably 4% for the portion of the sale price up to €50,000. The amount of the right is set by the legislator and recalled by the bailiff at each Catalogued Sale. For Online Sales, Bidders shall make prior inquiries and obtain all advice and information in this respect (for example on the following website: https://www.resaleright.be/). Should it appear that a resale right was not charged even though it is due to the author, the Buyer shall pay this resale right on first demand through Militaria Auctions and releases Militaria Auctions from all liability and claims in this respect.
Payment, invoicing and VAT
As soon as the Lot is adjudicated to a Buyer, the risks are transferred to them and they are required to pay the hammer price, increased by the fees, file fee and resale right as indicated above. Militaria Auctions accepts cash payments in compliance with the applicable regulations, bank transfers, certified cheques issued by a Belgian bank, as well as certain electronic payments. Settlement of purchases by electronic means does not in any way entail the liability of Militaria Auctions. Militaria Auctions is not responsible for any damage, direct or indirect, incurred through an internet payment. The Buyer therefore remains responsible for the proper execution of payment for the Lots acquired at Militaria Auctions auctions and may not rely on an error, a problem or any kind of “computer” fraud. Any request for invoicing must be made no later than eight working days following the date of adjudication. As Militaria Auctions operates under the special profit margin taxation scheme applicable to second-hand goods, works of art, collectors’ items or antiques, the VAT included in the sale price of the goods is not deductible by the Buyer.
Auction access restriction file
INFORMATION NOTICE
(1) Purpose and legal basis of the TEMIS File
Militaria Auctions subscribes to the TEMIS Service allowing consultation and contribution to the Auction Access Restriction File (“TEMIS File”) implemented by Commissaires-Priseurs Multimédia (CPM), a public limited company with executive board, having its registered office at (75001) Paris, 14 rue des Pyramides, registered with the Paris Trade and Companies Register under number 437 868 425.
Any auction invoice remaining unpaid with Militaria Auctions or having been subject to late payment may be registered in the TEMIS file.
The TEMIS File records payment incidents relating to auction invoices (late payments and defaults), regardless of the mode of participation of bidders (in person or remotely), and may be consulted by all auction sale structures subscribing to the service.
The bidder is informed that, failing regularisation of their auction invoice within the period stated on the invoice, a procedure for registration in said file may be initiated by Militaria Auctions.
The implementation of the TEMIS File and its use by Militaria Auctions is necessary for the purposes of the legitimate interest of subscribers to the TEMIS Service in preventing unpaid debts and thereby securing auction sales.
(2) Bodies authorised to consult the TEMIS File (recipients)
The TEMIS File may be consulted by any subscribed auction sale structure (professionals and companies authorised to conduct public auction sales of movable goods in accordance with the applicable regulations and notably the provisions of Title II “Auction sales” of Book III of the Commercial Code (hereinafter the “Subscribed Professionals”)), wishing to protect themselves against unpaid debts and thereby secure participation in the auction sales they organise. Consequence of registration in the TEMIS File
Where a bidder is registered in the TEMIS file, Militaria Auctions may make access to the auctions it organises conditional upon the use of specific means of payment or guarantees, or may temporarily refuse participation of bidders in auctions for which such guarantees cannot be implemented.
Registration in the TEMIS file may have the consequence of limiting the bidder’s ability to bid with professionals subscribed to the TEMIS service.
(3) Duration of registration
It also entails the temporary suspension of access to the “live” service of the platforms www.interencheres.com managed by CPM, in accordance with the general terms of use of those platforms.
Bidders are informed that the duration of registration in the TEMIS File is determined by the number of auction invoices remaining unpaid with Professionals Subscribed to the TEMIS File, by their cumulative amounts and by whether or not they are regularised. The duration of registration in the TEMIS File is reduced if the Bidder regularises all payment incidents. It is increased where the bidder is concerned by several unpaid invoices registered in the TEMIS File.
Registration of an auction invoice as a payment incident is deleted automatically at the latest after a period of 24 months where the bidder is subject to only one registration, and 36 months where the bidder is subject to several registrations.
(4) Responsibilities
For the application of personal data protection legislation, CPM and Militaria Auctions both have the status of data controller.
CPM is responsible for the implementation of the TEMIS File, which includes notably the collection of data from subscribers, the mutualisation and dissemination of the personal data recorded therein, as well as the security of the information system hosting the TEMIS File.
Militaria Auctions, as subscriber, is responsible for its use of the TEMIS File, which includes notably the communication to CPM of personal data relating to successful bidders for registration in the TEMIS File, the verification of accuracy and updating of data, consultation, as well as the reuse of information from the TEMIS File.
(5) Rights of individuals
Bidders wishing to know whether they are the subject of a registration in the File or to contest their registration may send their requests in writing, proving their identity by producing a copy of an identity document:
- For registrations made by Militaria Auctions: in writing to Militaria Auctions, Chaussée de Wavre 504/5A, 1390 Grez-Doiceau, Belgium,
For registrations made by other Subscribed Professionals: in writing to Commissaires-Priseurs Multimédia, 14 rue des Pyramides, 75001 Paris, or by e-mail to contact@temis.auction.
Any request aimed at exercising the rights of erasure, restriction, or objection available to the Bidder under personal data protection legislation, as well as any other challenge to a registration, must be addressed to the Professional at the origin of the registration, who shall submit a request for update to CPM. In case of difficulties, the bidder may refer the matter to CPM by providing any clarification and any supporting document so that CPM may examine the complaint.
(6) Bidder’s contact details
The bidder also has the right to lodge a complaint concerning their registration in the TEMIS File with the French Data Protection Authority (CNIL) [3 Place de Fontenoy – TSA 80715 – 75334 PARIS CEDEX 07, www.cnil.fr].
To learn more about the TEMIS File, the bidder is invited to consult CPM’s privacy policy available at temis.auction.
Important notifications relating to the consequences of adjudication shall be sent to the e-mail address and/or postal address declared by the bidder to the structure at the time of adjudication. The bidder must inform Militaria Auctions of any change to their contact details.
Collection of Lots
The Lots must be collected by the Buyer, after full payment, either during the sale or no later than within 5 working days following adjudication and by appointment. At the express written request of the Buyer, the purchased Lots may be shipped by an approved carrier at the sole expense and risk of the Buyer. Militaria Auctions may not be held liable for any loss and/or damage incurred, for whatever cause. During the period between the sale and the collection of the Lots, Militaria Auctions undertakes only to keep the Lots with reasonable care. Transport of the Lots is at the Buyer’s expense and Militaria Auctions is not responsible for damage or loss occurring during storage, packaging, handling or transport of the purchased Lots. Furthermore, Militaria Auctions is authorised to take, at its sole discretion, without prejudice to all other rights and actions, after formal notice by registered letter, one or other of the following measures:
• enforced performance of the sale, all costs including storage costs being borne by the Buyer;
• rescission of the sale to the detriment of the Buyer, all costs and damages being borne by the defaulting Buyer;
• resale, by auction or otherwise, any deficit compared with the first sale being borne exclusively by the defaulting Buyer, as well as all costs inherent in the resale.
Website
The Website is governed by Belgian law and therefore does not guarantee appropriate use in other countries. The User is solely responsible for compliance with the local laws and regulations that may apply to them. The Website may only be used for lawful purposes and the User undertakes to comply with all terms and provisions of the General Conditions. The Website may under no circumstances and on no pretext be used in such a way as to cause any prejudice whatsoever to Militaria Auctions or to a third party. If the Website contains hyperlinks to other websites, the liability of Militaria Auctions may not be engaged for any problem, damage, etc. resulting from visiting the referenced website(s). By way of non-exhaustive example, the liability of Militaria Auctions may never be engaged if a link present on the Website carries a virus or comes to damage in any way the User’s equipment, or for example if the referenced website(s) contain, whether intentionally or not, inaccurate, obsolete, incomplete information, etc. Militaria Auctions does not guarantee that the Website contains no errors and operates without interruption, nor that its contents and functionalities will at all times be accessible without interruption or breakdown. Militaria Auctions may, at any time and without warning or prior notification, modify, adapt or remove all or part of the contents and functionalities of the Website, temporarily take it out of service or limit its use, notably if it deems it necessary, for example in the context of maintenance, repair or (re)construction work. Different particular circumstances may arise and cause failures in the use of the Website and its functionalities, notably for Online Sales or bids placed online on the Website. These circumstances are not limited solely to cases of force majeure and include, by way of non-exhaustive example, technical problems making access to the Website and/or the proper conduct of the auctions (Online or Catalogued) impossible or partially impossible, as a result, for example, of disturbances in internet or telephone connection or caused by a virus or errors/defects. Militaria Auctions may not be held liable for such failures and reserves the right to decide what action to take if such problems should arise, in a discretionary manner. Militaria Auctions declines all liability or compensation for any prejudice arising from the (temporary) unavailability or a (temporary) interruption of its services and/or the Website. Militaria Auctions shall nevertheless undertake all necessary actions to notify Users, insofar as possible, by electronic mail, of any problem relating to the Website and of the return to normal operation of its services, without being held liable for non-delivery and/or non-receipt of the message(s) by the addressee(s). An FAQ tab is available to Users to enlighten them on frequently asked questions. If the User does not find an answer to their question there, Militaria Auctions will be pleased to try to help as far as possible. It is sufficient to write an e-mail.
Privacy policy
The processing of personal data relating to the Website and the services of Militaria Auctions is subject to the General Data Protection Regulation.
Militaria Auctions uses the TEMIS platform operated by Commissaires-Priseurs Multimédia for the purpose of managing the recovery of unpaid auction invoices. In this context, in the event of late payment, personal data relating to bidders, or their representatives, (notably identity and contact details of bidders, information relating to the sale, invoices) may be communicated to CPM for the purpose of amicable debt recovery. CPM acts as a processor within the meaning of the General Data Protection Regulation (Regulation EU 2016/679 of 27 April 2016).
Intellectual property
The Website, including the Online Sales system, is the property of Militaria Auctions. Militaria Auctions is the legal owner of the database and alone may grant any authorisation whatsoever to extract the information contained in the DB. All information provided and all services supplied, as well as the software necessary on the Website, are the property of Militaria Auctions. It is forbidden to copy, download or distribute any information present on the Website without the written consent of Militaria Auctions. The illustrations present in the catalogues and on the Website are subject to copyright (photographer or Militaria Auctions). No use of these illustrations may be made without the express written consent of Militaria Auctions. Descriptions of the Lots are also subject to copyright and may not be used without the agreement of Militaria Auctions. The text of the General Conditions is also protected by copyright and is the exclusive property of Militaria Auctions. No reproduction may be carried out without the agreement of Militaria Auctions, failing which legal proceedings may be brought.
Competent jurisdictions – Applicable law – Miscellaneous
Any dispute shall fall under the exclusive jurisdiction of the Courts of the judicial district of Wavre, sitting in the French language, under Belgian law exclusively. In the event that one or more clauses of the General Conditions were, in whole or in part, null, unenforceable or invalid for any reason whatsoever, such nullity, unenforceability or invalidity shall not prejudice the other provisions of the General Conditions. Militaria Auctions shall then in good faith replace the null, unenforceable or invalid part by another provision having an equivalent economic and legal effect. The present General Conditions are available in French, Dutch and English. In the event of contradiction between the French version and any other version or translation, the French version shall prevail.

Overeenkomstig de wet vallen de vermeldingen in de catalogus onder de verantwoordelijkheid van de Veilingmeester, onder voorbehoud van eventuele verbeteringen die worden aangekondigd op het ogenblik van de voorstelling van het voorwerp en worden opgenomen in het proces-verbaal van de verkoop. Het verslag betreffende de staat van het lot, met betrekking tot een ongeval of een restauratie, wordt opgesteld om de inspectie te vergemakkelijken en blijft onderworpen aan de beoordeling van een persoonlijk onderzoek door de koper of zijn vertegenwoordiger. Het ontbreken van een dergelijke vermelding in de catalogus houdt geenszins in dat een voorwerp vrij is van enig gebrek of enige restauratie. De voorafgaande tentoonstelling laat toe de staat van de goederen te bekijken; bijgevolg zal geen enkele klacht mogelijk zijn met betrekking tot gebruikelijke restauraties en kleine beschadigingen. De Lots worden te koop aangeboden zoals zij zich bevinden, met hun onvolkomenheden, gebreken en eventuele fouten in de beschrijving. Militaria Auctions kan in geen geval aansprakelijk worden gesteld voor de beschrijvingen en schattingen in de catalogi, aangezien deze louter indicatief zijn, met inbegrip van de door Militaria Auctions voorgestelde staatstabel. Hetzelfde geldt voor de vermeldingen betreffende de handtekening, de datum, de herkomst, de oorsprong en de staat van de Lots. De Kopers, al dan niet professioneel, hebben de mogelijkheid elk Lot te bekijken en te onderzoeken en/of alle informatie daarover op te vragen vóór de verkoop en tijdens de tentoonstelling ervan. Militaria Auctions behoudt zich het exclusieve recht voor om het Lot te fotograferen en al dan niet een foto op te nemen in de catalogus of op de Website. De foto’s in de catalogi of op de Website zijn niet contractueel en dienen uitsluitend ter informatie. De Bieder (met inbegrip van de Koper) zal zich zijn eigen mening vormen over het Lot en er zal geen enkele klacht van welke aard ook worden aanvaard, zelfs indien deze betrekking heeft op de beschrijving, de schatting, de inhoud of de staat van de Lots in de catalogus of op de Website zodra de toewijzing is uitgesproken. In ieder geval kan Militaria Auctions slechts aansprakelijk worden gesteld voor schade ten belope van het bedrag van de commissies die Militaria Auctions daadwerkelijk heeft ontvangen ten laste van de Verkoper en de Koper.
BIEDINGEN:
De biedingen volgen de volgorde van de catalogusnummers. Militaria Auctions is vrij om de volgorde van de biedingen te bepalen en de bieders zijn verplicht zich daaraan te houden. De hoogste en laatste bieder zal de koper zijn aan wie wordt toegewezen. In geval van een dubbel bod dat door Militaria Auctions als effectief wordt erkend, zal het voorwerp opnieuw te koop worden aangeboden en kunnen alle aanwezige liefhebbers deelnemen aan deze tweede toewijzing. Vanaf de toewijzing vallen de voorwerpen volledig onder de verantwoordelijkheid van de koper. Het is aan hem om de lots vanaf de toewijzing te verzekeren. Militaria Auctions behoudt zich evenwel de mogelijkheid voor om naar eigen goeddunken een bod te weigeren of een Bieder uit te sluiten, en dit vóór of tijdens een verkoop. De Bieder kan aankooporders geven en telefonisch deelnemen aan de biedingen (voor Catalogusverkopen). In dit laatste geval dient de Bieder zijn deelname aan de verkoop per brief of per e-mail te bevestigen, zijn identiteit mee te delen en alle inlichtingen te verstrekken die door Militaria Auctions zouden worden gevraagd. Deze behoudt zich met name het recht voor bankreferenties te vragen. Militaria Auctions kan niet aansprakelijk worden gesteld voor fouten van de Bieder, met inbegrip van fouten in de aanduiding van het Lotnummer, het telefoonnummer, of voor communicatieproblemen en/of problemen bij de ontvangst van brieven of e-mails (bezette telefoons, onderbroken lijnen, mobiele telefoons, enz.). De Bieder is zich bewust van en aanvaardt de risico’s die inherent zijn aan deze werkwijze. Indien twee aankooporders betrekking hebben op hetzelfde Lot voor hetzelfde bedrag, zal voorrang worden gegeven aan het eerst ontvangen order.
AFHALING VAN DE AANKOPEN
Vanaf de toewijzing valt het voorwerp onder de volledige verantwoordelijkheid van de koper aan wie het is toegewezen. De verkrijger zal zelf instaan voor de verzekering van zijn aankopen, en Militaria Auctions wijst alle verantwoordelijkheid af voor schade die het voorwerp zou kunnen oplopen, en dit vanaf de uitgesproken verwerving. Alle formaliteiten, met name deze betreffende de uitvoer, evenals het transport, blijven uitsluitend ten laste van de verkrijger. Het voorwerp kan, afhankelijk van zijn volume, in onze lokalen worden ondergebracht. De opslagkosten worden gedurende een periode van één maand vanaf de datum van de verkoop gedragen door Militaria Auctions. Na deze termijn bedraagt het tarief 25 € incl. btw per maand tot 5 m³. Het afhalen van het aangekochte lot gebeurt op afspraak en op vertoon van de betaalde factuur. De betaling blijft verschuldigd tijdens sluitingsperiodes.
Catalogusverkopen:
De Catalogusverkopen vinden fysiek plaats op een bepaalde datum en worden voorafgegaan door een tentoonstelling van de te koop gestelde Lots (met uitzondering van Lots die op aanwijzing worden verkocht en die desalniettemin kunnen worden onderzocht op de plaats waar zij zich bevinden). Zij worden gehouden onder toezicht van een gerechtsdeurwaarder en een veilingmeester. In geval van betwisting kan enkel de aanwezige gerechtsdeurwaarder of veilingmeester beslissen het Lot opnieuw te laten afroepen. Hun beslissing is onherroepelijk en bindend voor iedereen, zonder mogelijkheid tot betwisting.
Online Verkopen
De Online Verkopen verlopen uitsluitend via een internetplatform. Zij worden systematisch voorafgegaan door een tentoonstelling waarbij alle Lots “fysiek” kunnen worden onderzocht door iedere geïnteresseerde persoon. De biedingen worden automatisch beheerd door het computersysteem volgens de algemene beginselen van veilingen. In geval van betwisting omtrent de biedingen zullen de door het computersysteem geregistreerde gegevens doorslaggevend zijn en zal Militaria Auctions op die enige basis de winnende Bieder bepalen. Deze beslissing is onherroepelijk en bindend voor iedereen, zonder mogelijkheid tot betwisting. Militaria Auctions kan een Online Verkoop annuleren, uitstellen, verlengen of beëindigen zonder rechtvaardiging tegenover de Verkopers en de Bieders, potentieel of bestaand. Militaria Auctions kan de veiling na een onderbreking heropenen, met name indien zich een probleem heeft voorgedaan op de Website waardoor gebruikers deze niet op optimale wijze konden raadplegen, en dit op het tijdstip en op de wijze die haar het meest passend lijken. Militaria Auctions is als enige bevoegd om te beslissen over het uitstellen van een veilingverkoop in het geval dat de live-uitzending daarvan zou worden onderbroken.
Verkoper
De Verkoper verklaart meerderjarig en juridisch bekwaam te zijn.
Eigendom van het te koop aangeboden goed/Lot: De Verkoper verklaart en waarborgt aan Militaria Auctions dat hij de enige en exclusieve eigenaar is van het goed/de Lots die hij te koop aanbiedt en dat dit/deze vrij is/zijn van elk recht en/of elke last of welke belemmering dan ook. Militaria Auctions behoudt zich het recht voor om, zonder voorafgaande waarschuwing en zonder motiveringsplicht, een goed te weigeren en/of van de verkoop uit te sluiten waarvan de kwaliteit, herkomst en/of authenticiteit enige twijfel oproept. De Verkoper is verplicht na te gaan of de beschrijving, de schatting, de inhoud of de staat van de Lots in de catalogus of op de Website overeenstemmen met de werkelijkheid en heeft de mogelijkheid om Militaria Auctions tijdig op een fout te wijzen en/of een aanpassing voor te stellen. Indien hij niet tijdig een uitdrukkelijk voorbehoud formuleert waaraan Militaria Auctions geen gevolg heeft gegeven, vrijwaart de Verkoper Militaria Auctions tegen elke eventuele vordering tegen haar afkomstig van een Bieder (met inbegrip van de Koper) of van enige derde.
Reserveprijs: De Verkoper heeft het recht een reserveprijs voor de verkopen voor te stellen, dit wil zeggen een minimumprijs waaronder een goed/Lot niet zal worden toegewezen. Mits akkoord van Militaria Auctions zal deze reserveprijs op het consignatieformulier worden vermeld. De reserveprijs kan niet worden gewijzigd, behoudens akkoord van de Verkoper en Militaria Auctions. In geen geval zal een reserveprijs worden vastgesteld voor een Lot/goed dat op minder dan 200 € wordt geraamd. Indien het goed/Lot de overeengekomen reserve niet bereikt, zal het uit de verkoop worden genomen. In dat geval kan de Verkoper geen aanspraak maken op enige betaling en dient hij het goed/Lot op afspraak bij Militaria Auctions op te halen binnen de 15 dagen die volgen op de datum van de verkoop. Elk onverkocht goed/Lot dat niet binnen de vastgestelde termijn wordt opgehaald, zal worden opgeslagen op kosten (2 € per dag/per goed/Lot) en op risico van de Verkoper. Militaria Auctions kan niet aansprakelijk worden gesteld voor enig verlies en/of enige schade, ongeacht de oorzaak. Gedurende de periode tussen de verkoop en de ophaling van het onverkochte goed/Lot verbindt Militaria Auctions zich er enkel toe het goed/Lot als een goede huisvader te bewaren. Het vervoer van de Lots is ten laste van de Verkoper en Militaria Auctions is niet verantwoordelijk voor schade of verlies die zich zouden voordoen tijdens de opslag, de verpakking, de behandeling of het vervoer van het onverkochte goed/Lot. Bovendien, en onverminderd het voorgaande, heeft Militaria Auctions het recht om het goed/Lot opnieuw te koop aan te bieden, zonder voorafgaande kennisgeving, mits een vermindering van de reserveprijs met 30%, op risico en gevaar van de Verkoper, die uitdrukkelijk afziet van elke aanspraak op schadevergoeding of enige andere vergoeding. De Verkoper verbindt zich formeel ertoe niet te bieden of rechtstreeks of onrechtstreeks te laten bieden op een goed/Lot dat hij te koop aanbiedt. Militaria Auctions verbindt zich ertoe aan de Verkoper een bedrag te betalen gelijk aan de toewijzingsprijs van het Lot, verminderd met 20% kosten voor de verkopen, binnen een termijn van 30 dagen te rekenen vanaf de volledige betaling door de Koper. In geval van wanprestatie door de Koper kan Militaria Auctions beslissen de gedwongen uitvoering van de verkoop al dan niet na te streven. Bij gebrek aan vervolging zal de verkoop als nietig en zonder gevolg worden beschouwd en zal het Lot aan de Verkoper worden teruggegeven zonder enige andere tegenprestatie of schadeloosstelling. In dat geval, en indien de Verkoper daarom verzoekt, verbindt Militaria Auctions zich ertoe het Lot opnieuw te koop aan te bieden onder de tussen hen overeengekomen voorwaarden. Tenzij anders overeengekomen tussen de partijen, zal het vervoer van de te koop aangeboden goederen worden verzekerd en gedragen door Militaria Auctions. Behoudens voorafgaand schriftelijk akkoord van Militaria Auctions of een rechterlijke beslissing, mag het te koop aangeboden Lot dat is opgenomen in een consignatieformulier in geen geval vóór de verkoop worden teruggenomen. Het te koop aangeboden goed/Lot is verzekerd door Militaria Auctions vanaf de ontvangst ervan door Militaria Auctions. Door het consignatieformulier dat de Algemene Voorwaarden bevat te ondertekenen, erkent de Verkoper uitdrukkelijk hiervan kennis te hebben genomen en deze te aanvaarden, zonder enig voorbehoud of opmerkingen. Hij erkent een exemplaar van het consignatieformulier te hebben ontvangen.
Bieder
Om te kunnen bieden, moet de Gebruiker eerst beschikken over een geldige Gebruikersaccount. Militaria Auctions beschikt over volledige discretionaire vrijheid om een Gebruikersaccount al dan niet te valideren en om een bestaande Gebruikersaccount te verwijderen. De Bieder kan op verschillende manieren bieden: biedingen, aankooporders en telefonische biedingen, waarbij deze laatste enkel mogelijk zijn voor Catalogusverkopen. Militaria Auctions kan op discretionaire wijze beslissen een bod niet te aanvaarden of een Bieder uit te sluiten, en dit vóór of tijdens de verkoop. De Bieder wordt geacht de Algemene Voorwaarden te aanvaarden door het enkele feit van zijn inschrijving en deelname aan de verkoop.
Koper
De Koper is de Bieder aan wie het Lot wordt toegewezen. Elke Koper wordt ten aanzien van Militaria Auctions geacht in eigen naam te handelen, zelfs voor de Lots die hij als lasthebber of anderszins zou hebben verworven. De Koper zal aan Militaria Auctions zijn naam, adres, telefoonnummer, e-mailadres en identiteitskaart of paspoort meedelen, evenals alle inlichtingen, met name van bancaire aard, die door Militaria Auctions zouden worden gevraagd. De Koper wordt geacht de Algemene Voorwaarden te aanvaarden door het enkele feit van zijn inschrijving en/of deelname aan de verkoop.
Verkoopprijs en volgrecht
De verkoop wordt rechtstreeks gesloten tussen de Verkoper en de Koper volgens de toewijzingsprijs, verhoogd met:
- Voor de Catalogusverkopen, 26,2 % incl. btw aan kosten (zie verkoopvoorwaarden)
- Voor lots gewonnen via het platform LiveAuctioneers zal de koper een toeslag van 5 % incl. btw op de prijs moeten betalen
- Voor lots gewonnen via het platform Lot-tissimo zal de koper een toeslag van 5 % incl. btw op de prijs moeten betalen
- Voor lots gewonnen via het platform Interenchères zal de koper een toeslag van 1,8 % incl. btw op de prijs moeten betalen
Overeenkomstig de wettelijke bepalingen die een volgrecht heffen op de wederverkoop van originele kunstwerken in het kader van openbare veilingen ten voordele van de auteurs van de verkochte werken, zal door de Koper bovenop de verkoopprijs, exclusief belastingen, een volgrecht verschuldigd zijn, op voorwaarde dat de toewijzing gelijk is aan of hoger is dan 2.000 €. Het volgrecht is degressief; het bedraagt met name 4% voor de schijf van de verkoopprijs tot 50.000 €. Het bedrag van het recht wordt vastgesteld door de wetgever en door de gerechtsdeurwaarder herinnerd bij elke Catalogusverkoop. Voor Online Verkopen zullen de Bieders zich vooraf informeren en alle nodige raad en informatie hierover inwinnen (bijvoorbeeld op de volgende website: https://www.resaleright.be/). Indien blijkt dat een volgrecht niet werd aangerekend terwijl het aan de auteur verschuldigd is, betaalt de Koper dit volgrecht op eerste verzoek via Militaria Auctions en ontslaat hij Militaria Auctions van alle aansprakelijkheid en vorderingen dienaangaande.
Betaling, facturatie en btw
Vanaf de toewijzing van het Lot aan een Koper worden de risico’s op hem overgedragen en is hij gehouden de toewijzingsprijs te betalen, vermeerderd met de kosten, dossierrecht en het volgrecht zoals hierboven vermeld. Militaria Auctions aanvaardt contante betalingen binnen de grenzen van de geldende regelgeving, overschrijvingen, gecertificeerde cheques van een Belgische bank, evenals bepaalde elektronische betalingen. De betaling van aankopen langs elektronische weg doet op geen enkele wijze de aansprakelijkheid van Militaria Auctions ontstaan. Militaria Auctions is niet verantwoordelijk voor enige directe of indirecte schade die voortvloeit uit een betaling via internet. De Koper blijft dus verantwoordelijk voor het goede verloop van de betaling van de Lots verworven tijdens de veilingen van Militaria Auctions en kan zich niet beroepen op een fout, een probleem of enige vorm van “informatica”-fraude. Elk verzoek om facturatie moet uiterlijk binnen acht werkdagen na de datum van toewijzing worden gedaan. Aangezien Militaria Auctions werkt onder het bijzondere btw-stelsel van de winstmarge dat van toepassing is op tweedehandsgoederen, kunstwerken, verzamelobjecten of antiquiteiten, is de btw inbegrepen in de verkoopprijs van de goederen niet aftrekbaar voor de Koper.
Bestand van toegangsbeperkingen tot veilingen
INFORMATIENOTA
(1) Doel en rechtsgrond van het TEMIS-bestand
Militaria Auctions is geabonneerd op de TEMIS-dienst die de raadpleging en aanvulling mogelijk maakt van het bestand van toegangsbeperkingen tot veilingen (“TEMIS-bestand”), beheerd door Commissaires-Priseurs Multimédia (CPM), een naamloze vennootschap met directieraad, met maatschappelijke zetel te (75001) Parijs, 14 rue des Pyramides, ingeschreven in het handels- en vennootschapsregister van Parijs onder nummer 437 868 425.
Elke veilingfactuur die onbetaald blijft bij Militaria Auctions of waarvoor sprake is van laattijdige betaling, kan in het TEMIS-bestand worden opgenomen.
Het TEMIS-bestand registreert betalingsincidenten met betrekking tot veilingfacturen (laattijdige betalingen en wanbetalingen), ongeacht de wijze van deelname van bieders (aanwezig of op afstand), en kan worden geraadpleegd door alle veilingstructuren die op de dienst geabonneerd zijn.
De bieder wordt ervan in kennis gesteld dat, indien zijn veilingfactuur niet wordt geregulariseerd binnen de op de factuur vermelde termijn, Militaria Auctions een procedure tot opname in dit bestand kan opstarten.
De invoering van het TEMIS-bestand en het gebruik ervan door Militaria Auctions is noodzakelijk met het oog op het gerechtvaardigd belang van de abonnees op de TEMIS-dienst om wanbetalingen te voorkomen en aldus de veilingen te beveiligen.
(2) Instanties die gemachtigd zijn om het TEMIS-bestand te raadplegen (ontvangers)
Het TEMIS-bestand kan worden geraadpleegd door elke geabonneerde verkoopstructuur (professionals en vennootschappen die gemachtigd zijn om openbare verkopingen van roerende goederen te leiden overeenkomstig de toepasselijke regelgeving en met name de bepalingen van Titel II “Veilingen” van Boek III van het Wetboek van Koophandel (hierna de “Geabonneerde Professionals”)), die zich wensen te beschermen tegen wanbetalingen en aldus de deelname aan de door hen georganiseerde veilingen wensen te beveiligen. Gevolg van een inschrijving in het TEMIS-bestand
In het geval dat een bieder in het TEMIS-bestand is opgenomen, kan Militaria Auctions de toegang tot de door haar georganiseerde veilingen afhankelijk maken van het gebruik van specifieke betaalmiddelen of waarborgen, of tijdelijk de deelname van bieders weigeren aan veilingen waarvoor dergelijke waarborgen niet kunnen worden toegepast.
De opname in het TEMIS-bestand kan tot gevolg hebben dat de bieder in zijn mogelijkheid om te bieden wordt beperkt bij professionals die geabonneerd zijn op de TEMIS-dienst.
(3) Duur van de inschrijving
Dit brengt eveneens de tijdelijke schorsing met zich mee van de toegang tot de “live”-dienst van de platformen www.interencheres.com beheerd door CPM, overeenkomstig de algemene gebruiksvoorwaarden van die platformen.
De bieders worden ervan in kennis gesteld dat de duur van de inschrijving in het TEMIS-bestand wordt bepaald door het aantal veilingfacturen dat onbetaald is gebleven bij de op het TEMIS-bestand geabonneerde Professionals, door hun gecumuleerde bedragen en door het al dan niet geregulariseerd zijn ervan. De duur van de inschrijving in het TEMIS-bestand wordt verkort indien de Bieder alle betalingsincidenten regulariseert. Zij wordt verlengd wanneer de bieder betrokken is bij meerdere onbetaalde facturen die in het TEMIS-bestand zijn opgenomen.
De opname van een veilingfactuur als betalingsincident wordt automatisch geschrapt uiterlijk na een termijn van 24 maanden wanneer de bieder slechts aan één inschrijving onderworpen is, en van 36 maanden wanneer de bieder aan meerdere inschrijvingen onderworpen is.
(4) Verantwoordelijkheden
Voor de toepassing van de wetgeving inzake de bescherming van persoonsgegevens hebben CPM en Militaria Auctions beide de hoedanigheid van verwerkingsverantwoordelijke.
CPM is verantwoordelijk voor de invoering van het TEMIS-bestand, wat onder meer de verzameling van gegevens bij de abonnees omvat, de centralisering en verspreiding van de daarin opgenomen persoonsgegevens, evenals de beveiliging van het informatiesysteem dat het TEMIS-bestand host.
Militaria Auctions is als abonnee verantwoordelijk voor haar gebruik van het TEMIS-bestand, wat onder meer inhoudt de mededeling aan CPM van persoonsgegevens betreffende de kopers met het oog op opname in het TEMIS-bestand, de verificatie van de juistheid en de actualisering van de gegevens, de raadpleging, evenals het hergebruik van de informatie uit het TEMIS-bestand.
(5) Rechten van de betrokkenen
Bieders die wensen te weten of zij in het Bestand zijn opgenomen of hun inschrijving willen betwisten, kunnen hun verzoeken schriftelijk richten en hun identiteit aantonen door het overleggen van een kopie van een identiteitsbewijs:
- Voor inschrijvingen verricht door Militaria Auctions: schriftelijk aan Militaria Auctions, Chaussée de Wavre 504/5A, 1390 Grez-Doiceau, België,
Voor inschrijvingen verricht door andere Geabonneerde Professionals: schriftelijk aan Commissaires-Priseurs Multimédia, 14 rue des Pyramides, 75001 Parijs, of per e-mail aan contact@temis.auction.
Elk verzoek strekkende tot de uitoefening van het recht op wissing, beperking of verzet waarover de Bieder beschikt krachtens de wetgeving inzake de bescherming van persoonsgegevens, evenals elke andere betwisting van een inschrijving, moet worden gericht aan de Professional die aan de oorsprong van de inschrijving ligt, die een verzoek tot bijwerking bij CPM zal indienen. In geval van moeilijkheden kan de bieder CPM vatten door alle toelichtingen en bewijsstukken te verstrekken zodat CPM de klacht kan onderzoeken.
(6) Contactgegevens van de Bieder
De bieder beschikt eveneens over het recht om een klacht betreffende zijn opname in het TEMIS-bestand in te dienen bij de Franse Gegevensbeschermingsautoriteit (CNIL) [3 Place de Fontenoy – TSA 80715 – 75334 PARIS CEDEX 07, www.cnil.fr].
Om meer te weten te komen over het TEMIS-bestand wordt de bieder uitgenodigd het privacybeleid van CPM te raadplegen dat toegankelijk is op temis.auction.
Belangrijke kennisgevingen met betrekking tot de gevolgen van de toewijzing zullen worden gericht aan het e-mailadres en/of het postadres dat de bieder aan de structuur heeft meegedeeld op het ogenblik van de toewijzing. De bieder moet Militaria Auctions in kennis stellen van elke wijziging van zijn contactgegevens.
Afhaling van de Lots
De Lots moeten door de Koper worden afgehaald, na volledige betaling, hetzij tijdens de verkoop, hetzij uiterlijk binnen de 5 werkdagen na de toewijzing en op afspraak. Op uitdrukkelijk en schriftelijk verzoek van de Koper kunnen de aangekochte Lots door een erkende vervoerder worden verzonden op exclusieve kosten en risico van de Koper. Militaria Auctions kan niet aansprakelijk worden gesteld voor enig verlies en/of enige schade, ongeacht de oorzaak. Gedurende de periode tussen de verkoop en de afhaling van de Lots verbindt Militaria Auctions zich ertoe de Lots enkel als een goede huisvader te bewaren. Het transport van de Lots is ten laste van de Koper en Militaria Auctions is niet verantwoordelijk voor schade of verlies die zich zouden voordoen tijdens de opslag, de verpakking, de behandeling of het vervoer van de aangekochte Lots. Bovendien is Militaria Auctions gemachtigd om, naar eigen keuze, onverminderd alle andere rechten en vorderingen, na ingebrekestelling per aangetekende brief, een of andere van de volgende maatregelen te nemen:
• gedwongen uitvoering van de verkoop, alle kosten met inbegrip van opslagkosten ten laste van de Koper;
• ontbinding van de verkoop ten nadele van de Koper, alle kosten en schadevergoedingen ten laste van de in gebreke blijvende Koper;
• wederverkoop, al dan niet bij opbod, waarbij elk tekort ten opzichte van de eerste verkoop uitsluitend ten laste komt van de in gebreke blijvende Koper, evenals alle kosten inherent aan de wederverkoop.
Website
De Website wordt beheerst door het Belgische recht en garandeert derhalve geen passend gebruik in andere landen. De Gebruiker is als enige verantwoordelijk voor de naleving van de lokale wetgevingen en reglementeringen die op hem van toepassing zouden kunnen zijn. De Website mag enkel voor wettige doeleinden worden gebruikt en de Gebruiker verbindt zich ertoe alle voorwaarden en bepalingen van de Algemene Voorwaarden na te leven. De Website mag onder geen enkele omstandigheid en onder geen enkel voorwendsel worden gebruikt op een wijze die enig nadeel kan berokkenen aan Militaria Auctions of aan een derde. Indien de Website hyperlinks bevat naar andere websites, kan de aansprakelijkheid van Militaria Auctions niet worden ingeroepen voor enig probleem, schade, enz. dat voortvloeit uit het bezoek aan de vermelde website(s). Bij wijze van niet-limitatief voorbeeld kan de aansprakelijkheid van Militaria Auctions nooit worden ingeroepen indien een op de Website aanwezige link een virus bevat of op enigerlei wijze schade toebrengt aan de apparatuur van de Gebruiker, of bijvoorbeeld indien de vermelde website(s), al dan niet opzettelijk, onjuiste, verouderde, onvolledige informatie, enz. bevatten. Militaria Auctions garandeert niet dat de Website geen fouten bevat en zonder onderbreking werkt, noch dat de inhoud en functionaliteiten ervan te allen tijde zonder onderbreking of panne toegankelijk zullen zijn. Militaria Auctions kan op elk ogenblik en zonder waarschuwing of voorafgaande kennisgeving de inhoud en functionaliteiten van de Website geheel of gedeeltelijk wijzigen, aanpassen of verwijderen, deze voorlopig buiten dienst stellen of het gebruik ervan beperken, met name indien zij dit noodzakelijk acht, bijvoorbeeld in het kader van onderhouds-, herstellings- of (her)opbouwwerkzaamheden. Verschillende bijzondere omstandigheden kunnen zich voordoen en storingen veroorzaken in het gebruik van de Website en zijn functionaliteiten, met name voor Online Verkopen of biedingen die online op de Website worden geplaatst. Deze omstandigheden beperken zich niet tot gevallen van overmacht en omvatten, bij wijze van niet-limitatief voorbeeld, technische problemen die de toegang tot de Website en/of het goede verloop van de veilingen (Online of Catalogusverkopen) geheel of gedeeltelijk onmogelijk maken, bijvoorbeeld ten gevolge van verstoringen van de internet- of telefoonverbinding of veroorzaakt door een virus of fouten/gebreken. Militaria Auctions kan niet aansprakelijk worden gesteld voor deze storingen en behoudt zich het recht voor naar eigen goeddunken te beslissen welke actie moet worden ondernomen indien zich dergelijke problemen voordoen. Militaria Auctions wijst elke aansprakelijkheid of schadevergoeding af voor enig nadeel dat voortvloeit uit de (tijdelijke) onbeschikbaarheid of een (tijdelijke) onderbreking van haar diensten en/of van de Website. Militaria Auctions zal echter alle nodige maatregelen treffen om, voor zover mogelijk, de Gebruikers per e-mail op de hoogte te brengen van elk probleem met betrekking tot de Website en van de terugkeer naar een normale werking van haar diensten, zonder aansprakelijk te zijn voor het niet afleveren en/of het niet ontvangen van het bericht of de berichten door de bestemmeling(en). Er is een FAQ-tab beschikbaar voor de Gebruikers om hen wegwijs te maken in de vaak gestelde vragen. Indien de Gebruiker daar geen antwoord op zijn vraag vindt, zal Militaria Auctions graag trachten te helpen voor zover mogelijk. Het volstaat een e-mail te schrijven.
Privacybeleid
De verwerking van persoonsgegevens met betrekking tot de Website en de diensten van Militaria Auctions is onderworpen aan de Algemene Verordening Gegevensbescherming.
Militaria Auctions maakt gebruik van het TEMIS-platform dat wordt beheerd door Commissaires-Priseurs Multimédia, met het oog op het beheer van de invordering van onbetaalde veilingfacturen. In dit kader kunnen, in geval van laattijdige betaling, persoonsgegevens met betrekking tot de bieders, of hun vertegenwoordigers, (met name identiteit en contactgegevens van de bieders, informatie met betrekking tot de verkoop, facturen) worden meegedeeld aan CPM voor het beheer van minnelijke invordering van schuldvorderingen. CPM treedt op als verwerker in de zin van de Algemene Verordening Gegevensbescherming (Verordening EU 2016/679 van 27 april 2016).
Intellectuele eigendom
De Website, met inbegrip van het systeem van Online Verkopen, is eigendom van Militaria Auctions. Militaria Auctions is de wettelijke eigenaar van de databank en zij alleen kan enige toestemming verlenen om de in de DB vervatte informatie te extraheren. Alle verstrekte informatie en alle geleverde diensten, evenals de nodige software op de Website, zijn eigendom van Militaria Auctions. Het is verboden enige informatie aanwezig op de Website te kopiëren, te downloaden of te verspreiden zonder de schriftelijke toestemming van Militaria Auctions. De illustraties in de catalogi en op de Website zijn onderworpen aan het auteursrecht (fotograaf of Militaria Auctions). Geen enkel gebruik van deze illustraties mag worden gemaakt zonder de uitdrukkelijke schriftelijke toestemming van Militaria Auctions. Ook de beschrijvingen van de Lots zijn onderworpen aan het auteursrecht en mogen niet worden gebruikt zonder toestemming van Militaria Auctions. De tekst van de Algemene Voorwaarden is eveneens beschermd door het auteursrecht en is de exclusieve eigendom van Militaria Auctions. Geen enkele reproductie mag worden uitgevoerd zonder de toestemming van Militaria Auctions, op straffe van gerechtelijke vervolging.
Bevoegde rechtbanken – Toepasselijk recht – Diversen
Elk geschil valt onder de exclusieve bevoegdheid van de Rechtbanken van het gerechtelijk arrondissement Waver, zitting houdend in de Franse taal, met uitsluitende toepassing van het Belgische recht. In het geval dat één of meerdere clausules van de Algemene Voorwaarden geheel of gedeeltelijk nietig, onafdwingbaar of ongeldig zouden zijn om welke reden dan ook, zal deze nietigheid, onafdwingbaarheid of ongeldigheid geen afbreuk doen aan de overige bepalingen van de Algemene Voorwaarden. Militaria Auctions zal dan te goeder trouw het nietige, onafdwingbare of ongeldige deel vervangen door een andere bepaling met een gelijkwaardig economisch en juridisch effect. Deze Algemene Voorwaarden zijn beschikbaar in het Frans, het Nederlands en het Engels. In geval van tegenstrijdigheid tussen de Franse versie en enige andere versie of vertaling, prevaleert de Franse versie.
